Overcoming Georgia’s past barriers to in-state distribution

Four years after Haleigh’s Hope Act, Governor Brian Kemp signed the Georgia’s Hope Act of 2019. This established an official coalition to oversee the licensing of in-state production facilities and dispensaries for medical cannabis oil containing no more than 5 percent delta 9 THC.

While no Georgia dispensaries are open yet, lawmakers estimate that the state’s first dispensaries will be operational by the end of 2021. The low THC medical cannabis oil program will begin with six licensed production facilities that are authorized to operate up to 5 dispensaries each.

Additionally, the Georgia General Assembly recently passed a piece of legislation that, once signed into law, will extend Georgia pharmacies the right to distribute cannabis.

Before Governor Brian Kemp can sign the newly approved bill into law, the Georgia Board of Pharmacy must also approve the legislation. However, the attitude among the bill’s many proponents is “cautiously optimistic.”

In addition to making it legal to purchase cannabis oil from a pharmacy, the bill would also lift restrictions on the locations of dispensaries when it comes to proximity to schools, churches, and recreational centers.

Finally, there would be no limit on the amount of licensed pharmacies within the state, as the bill now stands.
